전남광주통합특별시 설치를 위한 특별법 제11조(통합특별시의 설치에 따른 다른 법령 적용상의 특례)

① 다른 법령에서 지방자치단체, 광역시 또는 도를 인용한 경우에는 각각 통합특별시를 포함한 것으로 보아 해당 법령을 적용한다.

② 다른 법령에서 지방의회의원 또는 광역시의회의원ㆍ도의회의원을 인용한 경우에는 각각 전남광주통합특별시의회(이하 "통합특별시의회"라 한다) 의원을 포함한 것으로 보아 해당 법령을 적용한다.

⑧ 통합특별시의 지방세 세목은 종전의 전라남도와 그 관할구역의 시ㆍ군 및 광주광역시와 그 관할구역의 자치구에 적용되던 「지방세기본법」 제8조를 적용하고 통합특별시의 지방세 부과ㆍ징수는 같은 법 제2조제1항제4호에 따른 지방세관계법을 적용한다.

⑨ 통합특별시의 조정교부금에 대하여 자치구는 종전의 광주광역시 보통세(「지방세법」 제71조제3항제3호가목 및 제4호가목에 따른 지방소비세액은 제외한다. 이하 같다) 세목을 재원으로 하고, 시ㆍ군은 종전의 전라남도 보통세 세목을 재원으로 한다.

⑩ 제1항부터 제9항까지에도 불구하고 개별 법령에서 광역시와 도에 적용되는 규정이 다른 경우 해당 법령이 개정될 때까지 자치구의 관할구역에 대해서는 광역시에 적용되는 법령을 적용하고, 시ㆍ군의 관할구역에 대해서는 도에 적용되는 법령을 적용한다. 다만, 관할구역을 기준으로 법령을 적용하기 곤란한 경우에는 해당 법령을 소관하는 국가기관의 장이 통합특별시장(교육감 소관 사무에 대해서는 통합특별시교육감을 말한다)의 의견을 들어 광역시 또는 도에 적용되는 규정 중 하나를 통합특별시에 적용하도록 결정할 수 있다.
