전북특별자치도 설치 및 글로벌생명경제도시 조성을 위한 특별법 제57조(산악관광진흥지구 내 「산지관리법」 등 적용의 특례)

① 산악관광사업에 대하여는 「산지관리법」 제12조 및 제18조에도 불구하고 보전산지에서의 행위제한, 산지의 경사도 및 표고에 관한 산지전용허가기준을 대통령령으로 달리 정할 수 있다.

② 사업시행자는 「백두대간 보호에 관한 법률」 제7조제2항에도 불구하고 산악관광진흥지구 내의 완충구역에서 산악관광사업의 시행에 필요한 다음 각 호의 어느 하나에 해당하는 행위를 할 수 있다.

③ 「자연공원법」 제18조제2항 각 호 외의 부분 단서, 제23조제1항 각 호 외의 부분 본문ㆍ단서, 같은 조 제4항 전단ㆍ후단에서 대통령령으로 정하도록 한 사항은 도조례로 달리 정할 수 있다. 다만, 도조례로 정할 수 있는 범위는 산악관광진흥지구 내의 도립공원 및 군립공원에 관한 사항으로 한정한다.

④ 도지사는 「산림보호법」 제11조제1항제1호에도 불구하고 산악관광진흥지구 내의 산림보호구역을 다음 각 호의 어느 하나에 해당하는 시설의 용지로 사용하려는 경우 그 지정의 전부 또는 일부를 해제할 수 있다.

⑤ 제4항에 따라 도지사가 해제할 수 있는 산림보호구역은 산림청 소관 국유림이 아닌 산림으로서 「산림보호법」 제7조제1항제1호부터 제4호까지에 따른 생활환경보호구역, 경관보호구역, 수원함양보호구역 및 재해방지보호구역에 한정한다.

⑥ 산악관광사업에 대하여는 「궤도운송법」 제4조의2제1항에 따른 국토교통부장관의 권한은 도지사의 권한으로 한다.
