집합건물의 소유 및 관리에 관한 법률 제56조(건축물대장의 신규 등록신청)

① 이 법을 적용받는 건물을 신축한 자는 1개월 이내에 1동의 건물에 속하는 전유부분 전부에 대하여 동시에 건축물대장 등록신청을 하여야 한다.

② 제1항의 신청서에는 제54조에 규정된 사항을 적고 건물의 도면, 각 층의 평면도(구분점포의 경우에는 「건축사법」 제23조에 따라 신고한 건축사 또는 「공간정보의 구축 및 관리 등에 관한 법률」 제39조제2항에서 정한 측량기술자가 구분점포의 경계표지에 관한 측량성과를 적어 작성한 평면도를 말한다)와 신청인의 소유임을 증명하는 서면을 첨부하여야 하며, 신청서에 적은 사항 중 규약이나 규약에 상당하는 공정증서로써 정한 것이 있는 경우에는 그 규약이나 공정증서를 첨부하여야 한다. <개정 2014.6.3>

③ 이 법을 적용받지 아니하던 건물이 구분, 신축 등으로 인하여 이 법을 적용받게 된 경우에는 제1항과 제2항을 준용한다.

④ 제3항의 경우에 건물 소유자는 다른 건물의 소유자를 대위(代位)하여 제1항의 신청을 할 수 있다.
