Monopoly Regulation and Fair Trade Act, Article 73 (Establishment and Composition of the Fair Trade Dispute Mediation Council)

① 제45조제1항을 위반한 혐의가 있는 행위와 관련된 분쟁을 조정하기 위하여 조정원에 공정거래분쟁조정협의회(이하 "협의회"라 한다)를 둔다.

④ 협의회 위원은 독점규제 및 공정거래 또는 소비자분야에 경험 또는 전문지식이 있는 사람으로서 다음 각 호의 어느 하나에 해당하는 사람 중에서 조정원의 장의 제청으로 공정거래위원회 위원장이 임명하거나 위촉한다. 이 경우 다음 각 호의 어느 하나에 해당하는 사람이 1명 이상 포함되어야 한다. <개정 2023.8.8>

⑤ 협의회 위원의 임기는 3년으로 한다.

⑥ 협의회 위원 중 결원이 생긴 때에는 제4항에 따라 보궐위원을 위촉하여야 하며, 그 보궐위원의 임기는 전임자의 남은 임기로 한다.

⑦ 공정거래위원회 위원장은 협의회 위원이 직무와 관련된 비위사실이 있거나 직무태만, 품위손상 또는 그 밖의 사유로 위원으로 적합하지 아니하다고 인정되는 경우 그 직에서 해임 또는 해촉할 수 있다.

⑨ 제8항에 따른 영리를 목적으로 하는 업무의 범위에 관하여는 「공공기관의 운영에 관한 법률」 제37조제3항을 준용한다. <신설 2024.2.6>

⑩ 협의회 위원장은 제9항에 따른 영리를 목적으로 하는 업무에 해당하는지에 대한 공정거래위원회 위원장의 심사를 거쳐 비영리 목적의 업무를 겸할 수 있다. <신설 2024.2.6>
