전기사업법 시행령 제62조(권한의 위임ㆍ위탁)
Enforcement Decree of the Electric Utility Act, Article 62 (Delegation and Entrustment of Authority)
① 기후에너지환경부장관은 법 제98조제1항에 따라 다음 각 호의 권한을 특별시장ㆍ광역시장ㆍ도지사 또는 특별자치도지사(이하 "시ㆍ도지사"라 한다)에게 위임한다. <개정 2013.3.23, 2020.9.29, 2021.1.5, 2025.10.1>
(1) The Minister of Climate, Energy and Environment delegates the following authority to a Special Metropolitan City Mayor, Metropolitan City Mayor, Do Governor, or Special Self-Governing Province Governor (hereinafter referred to as the "Mayor/Do Governor") under Article 98 (1) of the Act:
1. 발전시설 용량이 3천킬로와트 이하인 발전사업에 대한 다음 각 목의 권한
1. The following authority concerning power generation business with a generating facility capacity of 3,000 kilowatts or less:
가. 법 제7조제1항에 따른 전기사업의 허가
(a) Permission for electricity business under Article 7 (1) of the Act;
나. 법 제9조에 따른 준비기간의 지정ㆍ연장 및 사업개시 신고의 접수
(b) Designation and extension of the preparation period and receipt of business commencement reports under Article 9 of the Act;
다. 법 제10조에 따른 전기사업의 양수, 전기사업자인 법인의 분할ㆍ합병의 인가 및 공고 등
(c) Approval of and public notice on the transfer of electricity business and the division or merger of a corporation that is an electricity business operator under Article 10 of the Act;
라. 법 제12조에 따른 사업허가의 취소 및 사업의 정지, 사업구역의 감소, 과징금의 부과ㆍ징수 등
(d) Revocation of business permits, suspension of business, reduction of business areas, and imposition and collection of penalty surcharges under Article 12 of the Act;
마. 법 제13조에 따른 청문
(e) Hearings under Article 13 of the Act; and
바. 법 제31조의2제2항에 따른 사업정지 명령 및 같은 조 제3항에 따른 사업정지 명령의 유예 결정
(f) Business suspension orders under Article 31-2 (2) of the Act and decisions on a stay of business suspension orders under paragraph (3) of the same Article;
2. 설비용량이 1만킬로와트 미만인 발전설비, 전압이 20만볼트 미만인 송전ㆍ변전설비 또는 전압이 1만볼트 이상인 공동구(전기ㆍ가스ㆍ수도 등의 공급설비, 통신시설, 하수도시설 등 지하매설물을 공동 수용하는 지하 설치 시설물을 말한다) 및 전력구(전기 관련 설비를 설치하기 위한 지하 시설물을 말한다)의 배전선로에 대한 다음 각 목의 권한
2. The following authority concerning power generating facilities with a facility capacity of less than 10,000 kilowatts, power transmission and transformation facilities with a voltage of less than 200,000 volts, or distribution lines of common conduits (meaning underground facilities that jointly accommodate underground buried objects such as supply facilities for electricity, gas, and water, telecommunications facilities, and sewerage facilities) and power conduits (meaning underground facilities for installing electricity-related facilities) with a voltage of 10,000 volts or more:
가. 법 제61조제3항에 따른 공사계획의 신고 및 변경신고의 접수
(a) Receipt of reports and modification reports on construction plans under Article 61 (3) of the Act; and
나. 법 제71조에 따른 기술기준에의 적합명령
(b) Orders to conform to technical standards under Article 71 of the Act;
3. 설비용량이 1만킬로와트 미만인 전기설비에 대한 법 제61조제4항에 따른 공사 신고의 접수
3. Receipt of construction reports under Article 61 (4) of the Act concerning electrical facilities with a facility capacity of less than 10,000 kilowatts;

5. 법 제108조제2항제1호에 따른 과태료의 부과ㆍ징수 중 제1호나목에 따라 시ㆍ도지사의 권한으로 위임된 사항과 관련된 과태료의 부과ㆍ징수
5. Among the imposition and collection of administrative fines under Article 108 (2) 1 of the Act, the imposition and collection of administrative fines related to matters delegated as the authority of the Mayor/Do Governor under paragraph (1) 1 (b).

(3) Under Article 98 (2) of the Act, the Minister of Climate, Energy and Environment or the Mayor/Do Governor entrusts the following work to the Korea Electrical Safety Corporation under Article 30 of the Electricity Electrical Safety Management Act:

⑤ 기후에너지환경부장관은 법 제98조제4항에 따라 법 제67조에 따른 기술기준의 조사ㆍ연구 및 개정 검토에 관한 업무를 해당 업무를 수행할 수 있다고 인정되는 전기설비의 안전관리 관련 법인 또는 단체 중에서 기후에너지환경부장관이 지정하여 고시하는 법인 또는 단체에 위탁한다. <개정 2013.3.23, 2025.10.1>
(5) Under Article 98 (4) of the Act, the Minister of Climate, Energy and Environment entrusts the work of investigating, researching, and reviewing amendments to the technical standards under Article 67 of the Act to a corporation or organization designated and publicly notified by the Minister from among corporations or organizations related to the safety management of electrical facilities recognized as capable of performing the work.
⑥ 기후에너지환경부장관은 법 제98조제5항에 따라 다음 각 호의 업무를 다음 각 호의 구분에 따른 기관 또는 단체에 위탁한다. <신설 2018.12.11, 2024.8.6, 2025.10.1>
(6) Under Article 98 (5) of the Act, the Minister of Climate, Energy and Environment entrusts the following work to the following institutions or organizations, according to the following classification:
1. 법 제7조의2제1항 및 제4항에 따른 전기신사업의 등록 및 변경등록의 접수: 다음 각 목의 구분에 따른 기관 또는 단체
1. Receipt of registration and modification registration of new electricity business under Article 7-2 (1) and (4) of the Act: the following institutions or organizations according to the following classification:
가. 송전제약발생지역전기공급사업의 등록 및 변경등록의 접수: 한국전력거래소
(a) Receipt of registration and modification registration of transmission constraint area electricity supply business: Korea Power Exchange; and
나. 그 외 전기신사업의 등록 및 변경등록의 접수: 「지능형전력망의 구축 및 이용촉진에 관한 법률」 제20조에 따른 지능형전력망 협회
(b) Receipt of registration and modification registration of other new electricity business: Smart Grid Association under Article 20 of the Act on the Construction and Promotion of Use of Smart Grids; and
2. 법 제16조의2제1항에 따른 약관의 신고 및 변경신고의 접수: 한국전력거래소
2. Receipt of reports and modification reports on terms and conditions under Article 16-2 (1) of the Act: Korea Power Exchange.
