정보통신공사업법 시행령 제28조(공사실적등의 신고)

가. 국가, 지방자치단체, 공공기관, 특별법에 따라 설립된 법인 또는 「전기통신사업법」 제6조에 따라 등록된 기간통신사업자가 발주한 국내공사(기간통신사업자가 법 제12조 각 호의 어느 하나의 관계에 해당되는 공사업자에게 발주한 공사의 경우는 제외한다)의 경우: 발주자가 발행한 정보통신공사 실적증명서(해당 발주자가 제53조제2항제3호의 업무를 위탁받은 협회에 공사 실적을 미리 통보한 경우는 제외한다)

나. 가목 외의 자가 발주한 국내공사 및 국내하도급공사(재하도급공사를 포함한다)의 경우: 해당 공사의 발주자 또는 수급인(재하도급공사의 경우 하수급인을 말한다)이 발행한 다음의 서류. 다만, 발주자, 수급인 또는 하수급인의 폐업 등 부득이한 사유로 정보통신공사 실적증명서를 발급받을 수 없는 경우에는 그 사유서와 해당 공사에 대한 도급계약서(하도급 또는 재하도급인 경우에는 하도급계약서 또는 재하도급계약서를 말한다) 사본으로 1)의 서류를 대신할 수 있다.
