Enforcement Decree of the Seed Industry Act, Article 18 (Delegation and Entrustment of Authority)
① 농림축산식품부장관은 법 제53조제1항에 따라 다음 각 호의 권한 중에서 「산림자원의 조성 및 관리에 관한 법률」 제2조제8호에 따른 산림용 종자(산림용 묘목을 포함하며, 이하 "산림용종자"라 한다)에 관한 권한을 산림청장에게 위임한다. <개정 2016.6.21, 2017.6.27, 2023.12.26>
(1) Pursuant to Article 53 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates to the Commissioner of the Korea Forest Service, among the following authority, the authority concerning forest seeds under Article 2, subparagraph 8 of the Act on the Creation and Management of Forest Resources (including forest saplings; hereinafter referred to as "forest seeds"):
1. 법 제4조제1항에 따른 종자산업에 관한 통계 작성 및 실태조사
1. Compiling statistics and conducting fact-finding surveys on the seed industry under Article 4 (1) of the Act
2. 법 제4조제2항에 따른 자료 제출 요청
2. Requesting submission of data under Article 4 (2) of the Act
3. 법 제15조제1항에 따른 국가품종목록(이하 "품종목록"이라 한다)에의 등재
3. Listing in the national variety list under Article 15 (1) of the Act (hereinafter referred to as the "variety list")

(2) Pursuant to Article 53 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority (excluding authority concerning forest seeds) to the Director General of the National Seed Service:

③ 농림축산식품부장관은 법 제53조제1항에 따라 다음 각 호의 권한(산림용종자에 관한 권한은 제외한다)을 시장ㆍ군수ㆍ구청장에게 위임한다. <개정 2016.6.21>
(3) Pursuant to Article 53 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority (excluding authority concerning forest seeds) to heads of Si/Gun/Gu:
1. 제9조제1항에 따른 피해보상신청서의 접수
1. Receiving applications for compensation for damage under Article 9 (1)
2. 제9조제2항에 따른 피해사실확인서의 작성
2. Preparing damage confirmation certificates under Article 9 (2)
④ 산림청장 및 국립종자원장은 농림축산식품부장관의 승인을 받아 제1항 및 제2항에 따라 위임받은 권한의 일부를 소속 기관의 장에게 재위임할 수 있다. <개정 2016.6.21>
(4) The Commissioner of the Korea Forest Service and the Director General of the National Seed Service may, with the approval of the Minister of Agriculture, Food and Rural Affairs, re-delegate part of the authority delegated under paragraphs (1) and (2) to the heads of their affiliated agencies.
⑤ 농림축산식품부장관은 법 제53조제2항에 따라 다음 각 호의 권한을 농림축산식품부령으로 정하는 단체 중 농업 관련 법인 또는 단체에 위탁한다. <개정 2016.6.21>
(5) Pursuant to Article 53 (2) of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts the following authority to agriculture-related juristic persons or organizations among organizations prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs:
1. 법 제41조에 따른 수입적응성시험의 실시(산림용종자에 관한 권한은 제외한다)
1. Conducting import adaptability tests under Article 41 of the Act (excluding authority concerning forest seeds)
2. 법 제51조제1항제6호에 따른 수수료(제1호에 따라 위탁받은 사항과 관련된 것으로 한정한다) 징수
2. Collection of fees under Article 51 (1) 6 of the Act (limited to those related to matters entrusted under subparagraph 1)
