집합건물의 소유 및 관리에 관한 법률 제15조의2(권리변동 있는 공용부분의 변경)

① 제15조에도 불구하고 건물의 노후화 억제 또는 기능 향상 등을 위한 것으로 구분소유권 및 대지사용권의 범위나 내용에 변동을 일으키는 공용부분의 변경에 관한 사항은 관리단집회에서 구분소유자의 5분의 4 이상 및 의결권의 5분의 4 이상의 결의로써 결정한다. 다만, 「관광진흥법」 제3조제1항제2호나목에 따른 휴양 콘도미니엄업의 운영을 위한 휴양 콘도미니엄의 권리변동 있는 공용부분 변경에 관한 사항은 구분소유자의 3분의 2 이상 및 의결권의 3분의 2 이상의 결의로써 결정한다. <개정 2023.3.28>

② 제1항의 결의에서는 다음 각 호의 사항을 정하여야 한다. 이 경우 제3호부터 제7호까지의 사항은 각 구분소유자 사이에 형평이 유지되도록 정하여야 한다.

③ 제1항의 결의를 위한 관리단집회의 의사록에는 결의에 대한 각 구분소유자의 찬반 의사를 적어야 한다.

④ 제1항의 결의가 있는 경우에는 제48조 및 제49조를 준용한다.
