관세법 제329조(권한 또는 업무의 위임ㆍ위탁)
Customs Act, Article 329 (Delegation and Entrustment of Authority or Work)
① 이 법에 따른 재정경제부장관의 권한 중 다음 각 호의 권한은 대통령령으로 정하는 바에 따라 관세청장에게 위임할 수 있다. <신설 2021.12.21, 2025.10.1>
(1) Among the authority of the Minister of Economy and Finance under this Act, the following authority may be delegated to the Commissioner of the Korea Customs Service, as prescribed by Presidential Decree:
1. 제56조제2항에 따른 덤핑방지관세 재심사에 필요한 사항의 조사
1. Investigation of matters necessary for a review of anti-dumping duties under Article 56 (2);
2. 제62조제2항에 따른 상계관세 재심사에 필요한 사항의 조사
2. Investigation of matters necessary for a review of countervailing duties under Article 62 (2).
② 이 법에 따른 관세청장이나 세관장의 권한은 대통령령으로 정하는 바에 그 권한의 일부를 세관장이나 그 밖의 소속 기관의 장에게 위임할 수 있다. <개정 2021.12.21>
(2) Part of the authority of the Commissioner of the Korea Customs Service or the head of a customs office under this Act may be delegated to the heads of customs offices or of other affiliated agencies, as prescribed by Presidential Decree.
③ 세관장은 대통령령으로 정하는 바에 따라 제257조부터 제259조까지의 규정에 따른 권한을 체신관서의 장에게 위탁할 수 있다. <개정 2021.12.21>
(3) The head of a customs office may entrust the authority under Articles 257 through 259 to the heads of postal offices, as prescribed by Presidential Decree.
④ 세관장은 대통령령으로 정하는 바에 따라 제157조, 제158조제2항, 제159조제2항, 제165조제3항, 제209조, 제213조제2항(보세운송신고의 접수만 해당한다)ㆍ제3항, 제215조, 제222조제1항ㆍ제3항ㆍ제5항 및 제246조제1항에 따른 업무를 다음 각 호의 자에게 위탁할 수 있다. 다만, 제222조제1항ㆍ제3항ㆍ제5항에 따른 업무는 같은 조 제1항제1호 및 제2호에 관한 사항으로 한정한다. <개정 2019.12.31, 2021.12.21, 2024.12.31>
(4) The head of a customs office may entrust the work under Article 157, Article 158 (2), Article 159 (2), Article 165 (3), Article 209, Article 213 (2) (limited to receiving bonded transportation declarations) and (3), Article 215, Article 222 (1), (3) and (5), and Article 246 (1) to any of the following persons, as prescribed by Presidential Decree: Provided, That the work under Article 222 (1), (3) and (5) shall be limited to matters concerning subparagraphs 1 and 2 of paragraph (1) of the same Article:
1. 통관질서의 유지와 수출입화물의 효율적인 관리를 위하여 설립된 비영리법인
1. A non-profit corporation established to maintain order in customs clearance and efficiently manage export and import cargo;
2. 화물관리인
2. A cargo manager;
3. 운영인
3. An operator;
4. 제222조에 따라 등록한 보세운송업자
4. A bonded transportation business operator registered under Article 222.
⑤ 이 법에 따른 관세청장 또는 세관장의 업무 중 다음 각 호의 업무는 대통령령으로 정하는 바에 따라 대통령령으로 정하는 단체에 위탁할 수 있다. <개정 2021.12.21, 2024.12.31>
(5) Among the work of the Commissioner of the Korea Customs Service or the head of a customs office under this Act, the following work may be entrusted to organizations prescribed by Presidential Decree, as prescribed by Presidential Decree:
1. 제165조제1항에 따른 보세사 시험 업무
1. Work relating to the bonded goods manager examination under Article 165 (1);
2. 제173조제3항 단서에 따른 물품 검사비용 지원 업무 중 신청서 접수, 지원 요건 및 금액에 관한 심사
2. Among the work of supporting goods inspection costs under the proviso to Article 173 (3), receiving applications and examining eligibility requirements and amounts of support;
3. 제235조제2항에 따른 지식재산권 등의 신고 업무 중 신고서 접수 및 보완 요구
3. Among the work of reporting intellectual property rights and the like under Article 235 (2), receiving reports and requesting supplementation;
4. 제255조의2제2항에 따른 수출입안전관리우수업체 공인 심사 지원 및 같은 조 제3항에 따른 예비심사 지원
4. Support for examinations for certification of authorized economic operators under Article 255-2 (2), and support for preliminary examinations under paragraph (3) of the same Article;
5. 제265조에 따른 물품 또는 운송수단 등에 대한 검사 등에 관한 업무 중 국제항을 출입하는 자가 휴대하는 물품 및 국제항을 출입하는 자가 사용하는 운송수단에 대한 검사
5. Among the work relating to inspection of goods, means of transport and the like under Article 265, inspection of goods carried by persons entering or leaving an international port and of means of transport used by persons entering or leaving an international port.
