국가공무원 명예퇴직수당 등 지급 규정 제12조(조기퇴직수당 및 자진퇴직수당의 지급신청 등)

① 조기퇴직수당 또는 자진퇴직수당(이하 "조기퇴직수당등"이라 한다)을 지급받으려는 사람은 제11조제1항 또는 제2항에 따른 기간 내에 별지 제3호서식의 조기퇴직수당등 지급신청서에 다음 각 호의 서류를 첨부하여 소속기관의 장을 거쳐 소속 중앙행정기관의 장에게 제출하여야 한다. <개정 2025.6.2>

② 제1항에도 불구하고 제11조제6항에 따라 조기퇴직수당등의 지급대상이 되는 경우에는 같은 항 각 호의 어느 하나에 해당하게 된 때부터 3년 이내에 조기퇴직수당등의 지급신청을 할 수 있다. 이 경우 조기퇴직수당등의 지급신청을 할 때에는 별지 제3호서식의 조기퇴직수당등 지급신청서에 제1항 각 호의 서류와 제11조제6항 각 호의 어느 하나에 해당하는 사실을 증명할 수 있는 자료를 첨부하여 퇴직 전 소속기관의 장을 거쳐 소속 중앙행정기관의 장에게 제출해야 한다. <신설 2025.6.2>

③ 중앙행정기관의 장은 제1항 또는 제2항에 따라 조기퇴직수당등 지급신청서를 받으면 10일 이내에 지급 여부를 결정하고, 결정 즉시 그 결과를 소속기관의 장을 거쳐 신청인에게 알려야 한다. <개정 2025.6.2>

④ 중앙행정기관의 장은 제3항에 따라 지급 여부를 결정하기 전에 감사원, 고위공직자범죄수사처, 공소청, 중대범죄수사청, 경찰청 및 공무원연금공단 등에 제11조제4항 또는 제5항에 따른 지급제한대상 해당 여부와 근속기간을 확인하여야 한다. <개정 2013.4.22, 2020.7.14, 2025.6.2, 2026.9.29>

⑤ 조기퇴직수당등의 지급일에 관하여는 제5조제2항 및 제3항을 준용한다. 이 경우 "명예퇴직수당"은 "조기퇴직수당등"으로, "제3조제4항"은 "제11조제6항"으로, "제7조제1항"은 "제12조제3항"으로 본다. <신설 2019.12.24, 2025.6.2>
