기초연금법 제28조(권한의 위임ㆍ위탁)

① 이 법에 따른 보건복지부장관의 권한은 대통령령으로 정하는 바에 따라 그 일부를 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장에게 위임할 수 있다.

② 보건복지부장관 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 기초연금사업의 원활한 수행을 위하여 대통령령으로 정하는 바에 따라 다음 각 호의 업무를 「국민연금법」 제24조에 따른 국민연금공단에 위탁할 수 있다. <개정 2016.2.3>

③ 제1항과 제2항에 따라 권한을 위임ㆍ위탁받은 자에 대해서는 제11조제2항에 따라 제공되는 자료 또는 정보에 대하여 해당 법령에 따라 부과되는 사용료 또는 수수료 등을 면제한다.
