보호관찰 등에 관한 법률 제42조(유치)

① 보호관찰소의 장은 다음 각 호의 신청이 필요하다고 인정되면 제39조 또는 제40조에 따라 구인한 보호관찰 대상자를 수용기관 또는 소년분류심사원에 유치할 수 있다. <개정 2019.4.16>

② 제1항에 따른 유치를 하려는 경우에는 보호관찰소의 장이 검사에게 신청하여 검사의 청구로 관할 지방법원 판사의 허가를 받아야 한다. 이 경우 검사는 보호관찰 대상자가 구인된 때부터 48시간 이내에 유치 허가를 청구하여야 한다. <개정 2014.12.30>

③ 보호관찰소의 장은 유치 허가를 받은 때부터 24시간 이내에 제1항 각 호의 신청을 하여야 한다.

④ 검사는 보호관찰소의 장으로부터 제1항제1호의 신청을 받고 그 이유가 타당하다고 인정되면 48시간 이내에 관할 지방법원에 보호관찰을 조건으로 한 형의 선고유예의 실효 또는 집행유예의 취소를 청구하여야 한다.
