새마을금고법 시행령 제49조(외부감사대상금고)
Enforcement Decree of the Community Credit Cooperatives Act, Article 49 (Cooperatives Subject to External Audit)
① 법 제76조제3항에서 "대통령령으로 정하는 금고"란 다음 각 호의 금고를 말한다. <개정 2011.9.9, 2018.6.26, 2025.6.25>
(1) "Cooperatives prescribed by Presidential Decree" in Article 76 (3) of the Act means the following cooperatives:
1. 법 제74조제3항 및 제79조제3항ㆍ제4항ㆍ제6항에 따른 검사나 회계감사 또는 경영평가 결과 직전 사업연도 종료일 현재의 자산총액이 500억원 이상인 금고
1. A cooperative whose total assets as of the end of the immediately preceding business year are at least 50 billion won as a result of inspection, accounting audit, or management evaluation under Article 74 (3) and Article 79 (3), (4), and (6) of the Act;
2. 법 제74조제3항 및 제79조제3항ㆍ제4항ㆍ제6항에 따른 검사나 회계감사 또는 경영평가 결과 직전 사업연도 종료일 현재의 자산총액이 500억원 미만인 금고 중 다음 각 목의 어느 하나에 해당하는 금고
2. Among cooperatives whose total assets as of the end of the immediately preceding business year are less than 50 billion won as a result of inspection, accounting audit, or management evaluation under Article 74 (3) and Article 79 (3), (4), and (6) of the Act, a cooperative falling under any of the following items:
가. 직전 사업연도 종료일 현재 자기자본의 100분의 5에 상당하는 금액(그 금액이 1억원 미만인 경우에는 1억원)을 초과하여 이익금을 과대계상한 금고
(a) A cooperative that overstated profits in excess of an amount equivalent to 5/100 of equity capital as of the end of the immediately preceding business year (100 million won where that amount is less than 100 million won);
나. 직전 사업연도 종료일 현재 자기자본의 100분의 5에 상당하는 금액(그 금액이 1억원 미만인 경우에는 1억원)을 초과하여 손실금을 과소계상한 금고
(b) A cooperative that understated losses in excess of an amount equivalent to 5/100 of equity capital as of the end of the immediately preceding business year (100 million won where that amount is less than 100 million won).
② 법 제76조제4항에서 "대통령령으로 정하는 금고"란 직전 사업연도 종료일 현재의 자산총액이 3,000억원 이상인 금고를 말한다. <신설 2025.6.25>
(2) "Cooperatives prescribed by Presidential Decree" in Article 76 (4) of the Act means cooperatives whose total assets as of the end of the immediately preceding business year are at least 300 billion won.
