자유무역지역의 지정 및 운영에 관한 법률 시행령 제40조(권한의 위임ㆍ위탁)
Enforcement Decree of the Act on Designation and Operation of Free Trade Zones, Article 40 (Delegation and Entrustment of Authority)
① 법 제55조제2항에 따라 기획재정부장관은 자유무역지역에서의 「조세특례제한법」 제121조의2 및 제121조의4에 따른 외국인투자에 대한 조세감면 신청 및 조세감면 변경신청의 접수와 감면, 감면내용 변경, 감면대상 해당 여부의 결정ㆍ확인ㆍ통지에 관한 권한을 관리권자에게 위탁한다.
(1) Pursuant to Article 55 (2) of the Act, the Minister of Strategy and Finance entrusts to the administering authority authority concerning the receipt of applications for tax reduction or exemption and applications for change of tax reduction or exemption for foreign investment in free trade zones under Articles 121-2 and 121-4 of the Restriction of Special Taxation Act, and the granting of reduction or exemption, change of the content thereof, and determination, verification, and notification of whether the investment is eligible for reduction or exemption.
② 관리권자는 제1항에 따라 위탁받은 권한에 속하는 사무를 처리하였을 때에는 그 결과를 기획재정부장관에게 통보하여야 한다.
(2) When the administering authority has handled affairs falling under the authority entrusted under paragraph (1), it shall notify the Minister of Strategy and Finance of the result.
③ 법 제55조제3항에서 "대통령령으로 정하는 법인"이란 다음 각 호의 법인을 말한다.
(3) The "corporations prescribed by Presidential Decree" in Article 55 (3) of the Act means the following corporations:

(4) Pursuant to Article 55 (3) of the Act, the Minister of Trade, Industry and Energy delegates the following authority of the administering authority with respect to free trade zones in industrial complexes under Article 8 (1) 1 of the Act to the Director of the Free Trade Zone Management Office:

⑦ 해양수산부장관은 법 제55조제3항에 따라 법 제8조제1항제4호에 따른 항만 및 배후지의 국유 및 사유재산에 대한 다음 각 호의 권한을 지방해양수산청장에게 위임한다. 다만, 「항만공사법」 제6조에 따라 항만공사에 출자된 재산, 같은 법 제27조에 따라 해당 항만공사에 무상대부 또는 무상사용ㆍ수익이 허가된 재산, 해당 항만공사가 직접 취득한 재산, 「항만법」 제24조에 따라 지방자치단체에 항만시설관리권이 설정된 재산 및 같은 법 제66조에 따라 항만공사가 1종 항만배후단지관리기관으로 지정되어 관리하는 재산에 대한 제1호, 제3호, 제4호부터 제6호(매각으로 한정한다)까지, 제9호, 제13호부터 제18호까지에서 규정한 권한은 제외한다. <개정 2016.7.26, 2020.7.28, 2022.7.5>
(7) Pursuant to Article 55 (3) of the Act, the Minister of Oceans and Fisheries delegates the following authority with respect to State-owned and privately owned property in ports and hinterlands under Article 8 (1) 4 of the Act to the head of a Regional Office of Oceans and Fisheries. However, the authority prescribed in subparagraphs 1, 3, 4 through 6 (limited to sale), 9, and 13 through 18 is excluded with respect to property invested in a port authority under Article 6 of the Port Authority Act, property permitted to be lent free of charge or used and profited from free of charge to the relevant port authority under Article 27 of that Act, property directly acquired by the relevant port authority, property for which port facility management rights have been established for a local government under Article 24 of the Harbor Act, and property managed by a port authority designated as a Class 1 port hinterland management agency under Article 66 of that Act:

15. Imposition and collection of administrative fines under Article 70 (1), (2) 1, and (3) 1 of the Act
