전남광주통합특별시 설치를 위한 특별법 제63조(학교법인 설립ㆍ운영에 관한 특례)

① 「사립학교법」 제20조제2항 후단 및 제45조제2항부터 제4항까지에 따른 교육부장관의 권한은 같은 법 제4조제1항제1호의 학교를 설치ㆍ경영하는 학교법인에 대해서는 통합특별시교육감의 권한으로 하고, 같은 조 제3항제1호의 사립학교를 설치ㆍ경영하는 학교법인에 대해서는 통합특별시장의 권한으로 한다. 다만, 같은 법 제4조제3항제1호의 학교와 그 밖의 사립학교를 동시에 설치ㆍ경영하는 학교법인에 대해서는 통합특별시장의 권한으로 한다.

② 「사립학교법」 제10조의2제2항, 제18조의2제4항 단서, 같은 조 제5항 및 제21조제1항 단서에서 대통령령으로 정하도록 한 사항은 통합특별시조례로 정할 수 있다.

③ 「사립학교법」 제40조를 통합특별시에 준용할 때 "교육부장관"은 "교육부장관 또는 통합특별시장"으로 한다.

④ 통합특별시장은 지역 발전을 위하여 필요한 경우 미리 교육부장관의 동의를 받아 「사립학교법」 제4조제3항제2호 및 제3호에 따른 학교법인에 대하여 같은 법 제10조제1항에 따른 허가를 할 수 있다.

⑤ 「사립학교법」 제10조제1항 각 호 외의 부분 전단ㆍ후단에서 대통령령으로 정하도록 한 사항은 미리 교육부장관의 동의를 받아 통합특별시조례로 정할 수 있다.
