Act on Sustainable Management and Restoration of Tidal Flats and Surrounding Areas, Article 16 (Restrictions on Acts)
① 누구든지 관리구역에서 다음 각 호의 어느 하나에 해당하는 행위를 하여서는 아니 된다. 다만, 관리구역에 「습지보전법」 제8조에 따라 지정된 습지보호지역, 「자연공원법」 제4조에 따라 지정된 공원구역, 「문화유산의 보존 및 활용에 관한 법률」 제25조에 따른 국가지정문화유산(보호물ㆍ보호구역 및 역사문화환경 보존지역을 포함한다) 또는 「자연유산의 보존 및 활용에 관한 법률」 제11조 및 제12조에 따른 천연기념물 및 명승(보호물ㆍ보호구역 및 역사문화환경 보존지역을 포함한다)이 포함된 경우에는 「습지보전법」, 「자연공원법」, 「문화유산의 보존 및 활용에 관한 법률」, 「자연유산의 보존 및 활용에 관한 법률」에서 정하는 바에 따른다. <개정 2023.3.21, 2023.8.8, 2024.2.6>
(1) No one shall commit any of the following acts in a management zone. However, where a management zone includes a wetland protection area designated under Article 8 of the Wetlands Conservation Act, a park zone designated under Article 4 of the Natural Parks Act, national designated cultural heritage under Article 25 of the Act on the Protection and Utilization of Cultural Heritage (including protected objects, protection zones, and historic and cultural environment preservation zones), or natural monuments and scenic sites under Articles 11 and 12 of the Natural Heritage Conservation and Utilization Act (including protected objects, protection zones, and historic and cultural environment preservation zones), the Wetlands Conservation Act, the Natural Parks Act, the Act on the Protection and Utilization of Cultural Heritage, and the Natural Heritage Conservation and Utilization Act shall apply:
1. 건축물이나 그 밖의 인공구조물의 신축 또는 증축
1. New construction or extension of buildings or other artificial structures;
2. 관리구역의 구조를 변경하거나 해수의 수위 또는 수량에 증감을 가져오는 행위
2. Acts that change the structure of the management zone or increase or decrease the water level or volume of seawater;
3. 관리구역에서 토석 또는 광물을 채취하는 행위
3. Acts of extracting earth, stone, or minerals in the management zone.
② 다음 각 호의 어느 하나에 해당하는 경우에는 제1항을 적용하지 아니한다.
(2) Paragraph (1) shall not apply in any of the following cases:
1. 군사목적상 필요한 경우
1. Where necessary for military purposes;
2. 천재ㆍ지변 또는 이에 준하는 대통령령으로 정하는 재해가 발생하여 긴급한 조치가 필요한 경우
2. Where a natural disaster or a disaster equivalent thereto prescribed by Presidential Decree occurs and urgent measures are required;
3. 관리구역 인접지역 주민의 고유한 생활양식의 유지 또는 향상을 위하여 필요하거나 기존에 실시하던 영어(營漁)행위를 지속하기 위하여 필요한 행위 등 대통령령으로 정하는 경우
3. Cases prescribed by Presidential Decree, such as acts necessary to maintain or improve the unique lifestyle of residents of areas adjacent to the management zone or to continue existing fishing activities;
4. 갯벌조사 및 학술적 조사ㆍ연구를 목적으로 하는 행위 또는 관련 시설로서 해양수산부장관이 해양수산부령으로 정하는 바에 따라 해당 관리구역의 보전에 지장이 없다고 승인한 경우
4. Acts for the purpose of tidal flat surveys and academic surveys and research, or related facilities, which the Minister of Oceans and Fisheries has approved as not impeding conservation of the management zone concerned, as prescribed by Ordinance of the Ministry of Oceans and Fisheries;
5. 「어촌ㆍ어항법」 제2조에 따른 어촌종합개발사업 또는 어항개발사업으로서 제11조에 따른 관리계획에 포함된 사항을 시행하는 경우
5. Where a comprehensive rural and fishing village development project or fishing port development project under Article 2 of the Fishing Villages and Fishing Ports Act is implemented as included in the management plan under Article 11;
6. 해양수산부장관이 관리구역을 보호ㆍ관리하기 위하여 대통령령으로 정하는 행위를 하거나 필요한 시설을 설치하는 경우
6. Where the Minister of Oceans and Fisheries performs acts prescribed by Presidential Decree or installs necessary facilities to protect and manage the management zone.
