축산법 시행령 제26조(권한의 위임ㆍ위탁)
Enforcement Decree of the Livestock Industry Act, Article 26 (Delegation and Entrustment of Authority)
① 농림축산식품부장관은 법 제51조제1항에 따라 다음 각 호의 권한을 국립농산물품질관리원장에게 위임한다. <신설 2020.8.26>
(1) Pursuant to Article 51 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Commissioner of the National Agricultural Products Quality Management Service:
1. 법 제42조의2에 따른 무항생제축산물에 대한 인증
1. Certification of antibiotic-free livestock products under Article 42-2 of the Act
2. 법 제42조의6제2항에 따른 인증품의 생산방법과 사용자재 등에 관한 정보 표시의 권고
2. Recommendation of display of information on production methods and materials used for certified products under Article 42-6 (2) of the Act
3. 법 제42조의7제1항에 따른 인증의 취소, 인증표시의 제거ㆍ사용정지 또는 시정조치 명령
3. Revocation of certification, removal or suspension of use of certification marks, or corrective orders under Article 42-7 (1) of the Act
4. 법 제42조의7제2항에 따른 인증사업자에 대한 인증 취소의 통지 및 인증기관의 인증 취소 사실 보고의 수리
4. Notice of revocation of certification to certified businesses under Article 42-7 (2) of the Act and acceptance of reports by certification bodies on revocation of certification
5. 법 제42조의8제1항에 따른 인증기관의 지정
5. Designation of certification bodies under Article 42-8 (1) of the Act
6. 법 제42조의8제2항부터 제5항까지의 규정에 따른 인증기관의 지정 신청의 접수, 지정갱신, 평가업무의 위임ㆍ위탁, 변경신고의 수리 및 변경 승인
6. Receipt of applications for designation of certification bodies, renewal of designation, delegation or entrustment of evaluation work, acceptance of reports of change, and approval of change under Article 42-8 (2) through (5) of the Act
7. 법 제42조의10제1항에 따른 인증품 및 인증사업자에 대한 조사의 실시, 시료의 무상 제공 요청ㆍ검사 및 자료 제출 등의 요구
7. Investigation of certified products and certified businesses, requests for free provision and testing of samples, and demands for submission of data under Article 42-10 (1) of the Act
8. 법 제42조의10제5항부터 제7항까지의 규정에 따른 조사 결과의 통지, 시료의 재검사 요청 접수, 재검사 여부 결정ㆍ통보 및 재검사 결과 통보
8. Notice of investigation results, receipt of requests for retesting of samples, decisions on and notice of whether to retest, and notice of retest results under Article 42-10 (5) through (7) of the Act
9. 법 제42조의10제8항부터 제11항까지의 규정에 따른 인증 취소 등의 조치명령 및 인증기관에 대한 조치 요청, 인증품의 압류 및 조치명령의 내용 공표
9. Orders for measures such as revocation of certification and requests to certification bodies for measures, seizure of certified products, and public disclosure of the content of orders for measures under Article 42-10 (8) through (11) of the Act
10. 법 제42조의11제2항 및 제3항에 따른 인증기관의 지위 승계 신고의 수리 및 신고수리 여부의 통지
10. Acceptance of reports of succession to the status of certification bodies and notice of whether reports are accepted under Article 42-11 (2) and (3) of the Act
11. 법 제42조의12에 따라 준용되는 다음 각 목의 규정에 따른 권한
11. Authority under the following items applied mutatis mutandis under Article 42-12 of the Act:
가. 「친환경농어업 육성 및 유기식품 등의 관리ㆍ지원에 관한 법률」(이하 이 호에서 "법"이라 한다) 제26조의2제1항에 따른 인증심사원의 자격 부여
(a) Granting of qualification as a certification examiner under Article 26-2 (1) of the Act on the Fostering of Eco-Friendly Agriculture and Fisheries and the Management and Support of Organic Food (hereinafter referred to as the "Act" in this subparagraph)
나. 법 제26조의2제2항에 따른 인증심사원의 자격을 부여받으려는 자에 대한 교육
(b) Education of persons who seek qualification as a certification examiner under Article 26-2 (2) of the Act
다. 법 제26조의2제3항에 따른 인증심사원의 자격 취소ㆍ정지 또는 시정조치 명령
(c) Revocation or suspension of qualification as a certification examiner or corrective orders under Article 26-2 (3) of the Act
라. 법 제27조제1항제2호에 따른 인증기관에 대한 접근 및 정보ㆍ자료 제공의 요청
(d) Access to certification bodies and requests for provision of information and data under Article 27 (1) 2 of the Act
마. 법 제27조제1항제4호에 따른 인증기관의 인증 결과 및 사후관리 결과 등에 대한 보고의 수리
(e) Acceptance of reports on certification results and follow-up management results of certification bodies under Article 27 (1) 4 of the Act
바. 법 제27조제1항제5호에 따른 인증사업자에 대한 불시(不時) 심사 및 그 결과의 기록ㆍ관리
(f) Unannounced examination of certified businesses and recording and management of the results under Article 27 (1) 5 of the Act
사. 법 제28조에 따른 인증기관의 인증업무 휴업ㆍ폐업 신고의 수리
(g) Acceptance of reports of suspension or closure of certification work by certification bodies under Article 28 of the Act
아. 법 제29조제1항 및 제2항에 따른 인증기관의 지정취소ㆍ업무정지 또는 시정조치 명령 및 그 지정취소ㆍ업무정지 처분사실의 인터넷 홈페이지 게시
(h) Revocation of designation, suspension of work, or corrective orders for certification bodies under Article 29 (1) and (2) of the Act, and posting of the fact of revocation of designation or suspension of work on the internet website
자. 법 제32조제1항에 따른 인증기관에 대한 조사
(i) Investigation of certification bodies under Article 32 (1) of the Act
차. 법 제32조제2항에 따른 인증기관에 대한 지정취소ㆍ업무정지 또는 시정조치 명령
(j) Revocation of designation, suspension of work, or corrective orders for certification bodies under Article 32 (2) of the Act
카. 법 제32조의2제1항 및 제2항에 따른 인증기관의 평가ㆍ등급결정 및 결과 공표, 평가ㆍ등급결정 결과의 인증기관 관리ㆍ지원ㆍ육성 등에의 반영
(k) Evaluation and grading of certification bodies and public disclosure of results, and reflection of evaluation and grading results in management, support, and fostering of certification bodies under Article 32-2 (1) and (2) of the Act
타. 법 제57조제1항제2호 및 제3호에 따른 인증심사원의 자격 취소 및 인증기관의 지정취소에 대한 청문
(l) Hearings on revocation of qualification as a certification examiner and revocation of designation of certification bodies under Article 57 (1) 2 and 3 of the Act
12. 법 제49조제1항제3호에 따른 수수료의 수납
12. Collection of fees under Article 49 (1) 3 of the Act
13. 법 제56조제3항에 따른 과태료의 부과ㆍ징수(같은 조 제2항제9호부터 제18호까지의 규정에 따른 위반행위로 한정한다)
13. Imposition and collection of administrative fines under Article 56 (3) of the Act (limited to violations under Article 56 (2) 9 through 18)
② 국립농산물품질관리원장은 제1항에 따라 위임받은 권한의 일부를 농림축산식품부장관의 승인을 받아 소속기관의 장에게 재위임할 수 있다. 이 경우 국립농산물품질관리원장은 그 재위임한 내용을 고시해야 한다. <신설 2020.8.26>
(2) The Commissioner of the National Agricultural Products Quality Management Service may, with the approval of the Minister of Agriculture, Food and Rural Affairs, redelegate part of the authority delegated under paragraph (1) to the head of an affiliated agency. In this case, the Commissioner of the National Agricultural Products Quality Management Service shall publicly notify the content of the redelegation.
③ 시ㆍ도지사는 법 제51조제3항에 따라 법 제13조제1항에 따른 수정사에 대한 교육의 실시를 법 제5조제3항에 따라 지정한 가축개량기관에 위탁한다. <신설 2019.12.31, 2020.8.26>
(3) Pursuant to Article 51 (3) of the Act, the Mayor/Do Governor entrusts the conduct of education for inseminators under Article 13 (1) of the Act to the livestock improvement institution designated under Article 5 (3) of the Act.
④ 법 제51조제4항에서 "대통령령으로 정하는 축산 관련 법인 및 단체"란 법 제36조에 따른 축산물품질평가원(이하 이 조에서 "축산물품질평가원"이라 한다), 「가축전염병예방법」 제9조에 따른 가축위생방역 지원본부, 「가축분뇨의 관리 및 이용에 관한 법률」 제38조의2에 따른 축산환경관리원 및 농림축산식품부장관이 별도로 고시하는 축산 관련 기관을 말한다. <신설 2013.2.20, 2013.3.23, 2019.12.31, 2020.2.25, 2020.8.26>
(4) The term "livestock-related corporations and organizations prescribed by Presidential Decree" in Article 51 (4) of the Act means the Institute for Livestock Products Quality Evaluation under Article 36 of the Act (hereinafter referred to as the "Institute for Livestock Products Quality Evaluation" in this Article), the Livestock Health and Disease Control Support Headquarters under Article 9 of the Act on the Prevention of Contagious Animal Diseases, the Korea Institute for Animal Environment under Article 38-2 of the Act on the Management and Use of Livestock Manure, and livestock-related institutions separately publicly notified by the Minister of Agriculture, Food and Rural Affairs.
⑤ 농림축산식품부장관은 법 제51조제5항에 따라 법 제29조제1항에 따른 종축 등의 수출입 신고에 관한 업무를 농림축산식품부장관이 지정ㆍ고시하는 종축개량업무를 행하는 비영리법인에 위탁한다. 다만, 종계와 종란의 수출입 신고에 관한 업무는 농림축산식품부장관이 지정ㆍ고시하는 양계 관련 업무를 담당하는 비영리법인에 이를 위탁한다. <개정 2008.2.29, 2013.2.20, 2013.3.23, 2019.12.31, 2020.8.26>
(5) Pursuant to Article 51 (5) of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts the duties relating to reports on the import and export of breeding livestock, etc. under Article 29 (1) of the Act to a non-profit corporation engaged in breeding livestock improvement work designated and publicly notified by the Minister of Agriculture, Food and Rural Affairs; provided, that duties relating to reports on the import and export of breeding hens and hatching eggs shall be entrusted to a non-profit corporation in charge of poultry-related work designated and publicly notified by the Minister of Agriculture, Food and Rural Affairs.

⑦ 농림축산식품부장관은 법 제51조제7항에 따라 법 제40조의2에 따른 전자민원창구의 설치ㆍ운영에 관한 업무를 축산물품질평가원에 위탁한다. <신설 2020.2.25, 2020.8.26>
(7) Pursuant to Article 51 (7) of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts the duties relating to the establishment and operation of the electronic civil petition window under Article 40-2 of the Act to the Institute for Livestock Products Quality Evaluation.
